General terms and conditions of business

of the Moyland Castle Museum Foundation – Van der Grinten Collection – Joseph Beuys Archive of the State of North Rhine-Westphalia, Am Schloss 4, 47551 Bedburg-Hau, Germany

Section 1: Scope

These Terms and Conditions (T&C) form an integral part of the contracts concluded between you and us, the Moyland Castle Museum Foundation. Any deviations from these T&C require our written consent to be valid, unless they constitute a separate agreement.

Section 2: Conclusion of the Contract; Purchase of Goods; Purchase of Admission Tickets; House Rules

(2) Unless otherwise specified below, a contract is concluded only upon confirmation of the order by the Moyland Castle Museum Foundation or upon delivery of the goods to the carrier within 14 days of receipt of the order, when an order is placed via a means of distance communication (e.g., telephone, email, letter, fax).

(3) Sales are made only in standard commercial quantities. If the quantity of products requested by the customer is not available, the customer will be notified of this before the contract is concluded; in such cases, the customer is no longer bound by their offer.

(4) When purchasing goods (e.g., catalogs, illustrated books, literature, postcards), the prices set by the Museum Schloss Moyland Foundation apply, as displayed in the museum shop (sales counter).

(5) Purchasing tickets; Concluding a contract for online tickets:

(a) The prices listed by the Moyland Castle Museum Foundation at the time of purchase in the museum shop (sales counter) apply. Prices are subject to change (particularly during special exhibitions); the purchase price is due immediately upon conclusion of the contract, unless the customer is granted a later payment term.

(b) The following applies to online tickets (conclusion of the online ticket contract):
When purchasing tickets online, the order is placed by clicking the designated button (“Buy Now”). After payment, the customer will receive the ordered ticket(s) as a PDF file sent to the email address provided during the ordering process. The customer may print the ticket(s) and present them in paper form or open them on their electronic device (e.g., smartphone, tablet) at the entrance. The tickets are numbered and feature a barcode or QR code. They cannot be used more than once.

The customer is required to provide accurate information during the ordering process. The customer is responsible for any input errors (e.g., an incorrect email address). The customer bears the risk associated with the accuracy of the information provided. The customer is also responsible for any technical issues on the recipient’s end.

(c) Discounted tickets may only be purchased for one or more eligible individuals. Eligible individuals include schoolchildren, college students, visitors with disabilities, groups of a certain size or larger, recipients of public assistance, and individuals participating in the Federal Volunteer Service. There is no legal entitlement to purchase a discounted ticket. Discounted tickets are valid only when presented with a photo ID confirming or justifying eligibility for the discount. In the event of unauthorized use of a discounted ticket, the difference in price may be charged, or the person in question may be asked to leave the museum. In the latter case, the price of the ticket will not be refunded, not even partially.

(6) If a ticket is transferred to another person (e.g., as a gift), it is the responsibility of the previous ticket holder or authorized person to inform the recipient that the Museum Schloss Moyland Foundation’s Terms and Conditions apply to all visitors.

(7) As a general rule, tickets may only be returned and the purchase price refunded in the event of event cancellation or rescheduling. In addition, as a gesture of goodwill, paid tickets may be returned or exchanged only in exchange for a ticket voucher for the museum, provided the ticket has not yet been used or the event has not already begun.

No replacements will be provided for lost tickets or for tickets that have not been used or have been used only partially.

(8) In addition to these Terms and Conditions, the organizer’s house rules also apply on the event grounds; these rules are posted in appropriate locations and are available at https://www.moyland.de/information/hausordnung.

Section 3: Disclosure Requirements, Right of Withdrawal / Withdrawal Policy

(1) We, the Moyland Castle Museum Foundation, do not store the full text of the contract. Before submitting an order through our online shop, the contract details can be printed using your browser’s print function or saved electronically. Once we receive the order, the order details, the legally required information for distance contracts, and the Terms and Conditions will be sent again to the customer via email.

(2) The Moyland Castle Museum Foundation separately informs customers of their right of withdrawal, which is available at https://www.moyland.de/information/widerrufsbelehrung. Pursuant to Section 312g(2)(9) of the German Civil Code (BGB), there is no right of withdrawal for the purchase of tickets.

(3) Photographs and videos are taken at events held on the grounds of the Schloss Moyland Museum. The museum uses these for promotional purposes on social media and other channels. By attending the event, visitors automatically consent to this. Signs indicating this policy are posted in appropriate locations.

Section 4: Payment, Shipping, and Delivery Times

(1) The Moyland Castle Museum Foundation is exempt from value-added tax pursuant to Section 4(20a) of the German Value-Added Tax Act (UStG), provided that the transactions do not constitute commercial business operations. Payment is made in advance by the contracting party/customer.

(2) Shipping rates within Germany are based on the rates charged by Deutsche Post and DHL. The shipping cost within Germany is €6.00. A shipping fee of €15.00 per order applies to deliveries within the European Union. We do not ship to countries outside the European Union.

(3) Payment under the executed contract is due immediately and in full. No discount is offered. Should you fail to make payment on time, we reserve the right to charge late fees and interest on overdue payments in accordance with applicable law.

(4) Unless otherwise specified or agreed upon during the ordering process, the ordered goods will generally be shipped as soon as payment is confirmed in one of the following accounts:

Delivery is generally made to the shipping address provided by the customer. Unless advance payment is made in individually agreed cases, the goods remain our property until full payment has been received. Until that time, the goods may not be pledged, transferred as security, or encumbered with any other rights, except in cases permitted by law. The customer is obligated to treat the item with care until ownership has been transferred to him.

(5) The risk of loss or damage to the ordered goods passes to the purchaser/customer as soon as the shipment is handed over to the carrier. This does not apply if the purchaser is a consumer as defined in Section 13 of the German Civil Code (BGB).

Section 5: Retention of title, late payment

The goods remain the property of the seller until the purchase price and any applicable shipping costs have been paid in full. Until that time, the goods may not be pledged, transferred as security, or encumbered with any other rights. The buyer is obligated to treat the goods with care until ownership has been transferred to them.

Section 6: Warranty, Liability, Force Majeure

(1) All warranties are governed by the provisions of applicable law. If the purchaser is a business, claims for defects shall expire one year after the date of delivery.

(2) If a defect is found, the sender is entitled, at its discretion, to remedy the defect or provide a replacement within a reasonable period of time.

(3) Liability for breaches of duty resulting from slight negligence is excluded, unless the breach involves injury to life, limb, or health, or affects warranties or claims under the Product Liability Act. Furthermore, liability remains unaffected for breaches of obligations whose fulfillment is essential to the proper performance of the contract and on whose compliance you, as the customer, may reasonably rely. The same applies to breaches of duty by our agents.

(4) The seller shall be liable in accordance with the provisions of law if the buyer asserts claims for damages based on willful misconduct or gross negligence, or if the seller culpably breaches a material contractual obligation; this includes willful or grossly negligent acts by agents or vicarious agents. Unless the sender is accused of an intentional breach of contract, liability for damages is limited to foreseeable, typically occurring damages.

(5) Unless otherwise provided above, liability is excluded—except in cases of culpable injury to life, limb, or health—regardless of the legal nature of the claim asserted. This applies in particular to claims for damages arising from negligence in the conclusion of the contract, from other breaches of duty, or from tortious claims for compensation for property damage pursuant to § 823 of the German Civil Code (BGB).

(6) To the extent that the sender’s liability for damages is excluded or limited, this also applies to the personal liability for damages of employees, staff members, representatives, and agents.

(7) In the event of cancellation, interruption, or modification of an event due to circumstances demonstrably beyond the organizer’s control, such as force majeure (including, but not limited to, acts of terrorism, assassinations, threats of assassination, war, and civil war, or war-like events, strikes, lockouts, labor disputes, riots, and/or civil unrest, severe weather, flooding, pandemics/epidemics), and/or in the event of official cancellation due to the aforementioned or other circumstances, the parties shall be released from their respective contractual obligations.

(8) If the event is rescheduled, the tickets will remain valid for the new date.

Section 7: General Provisions, Jurisdiction, Severability Clause

(1) German law shall apply in all cases, to the exclusion of the UN Convention on Contracts for the International Sale of Goods and international private law. If the customer is not a consumer, German law shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of performance and jurisdiction shall be Kleve, Germany, to the extent permitted by law.

(2) Any amendments or additions to the contract entered into with the sender must be made in writing. This also applies to any waiver of the written form requirement.

(3) If any provision of this agreement is or becomes invalid, the validity of the remainder of the agreement shall not be affected. The invalid provision shall be replaced by a provision that comes as close as possible to the intended purpose within the limits of what is legally permissible.
